Pinpoint IT (“we,” “us” the “Company“) offers you the opportunity to earn rewards by referring colleagues to try our Service (The “Service“). Your participation in the Pinpoint IT Referral Program (“Pinpoint IT Referral Program” or “Program“) can earn you up to 5% per referral and may also get you additional rewards. We reserve the right to terminate the Program at any time for any reason. The Program is administered by Pinpoint IT, which may outsource certain elements of administration to third parties (collectively “Administrator“).
These terms (“Terms“) apply to a user’s participation in the Program. By participating in the Program, users agree to use the Program as outlined herein, and consistent with any other terms we may apply to the Program. If you do not agree to these Terms in their entirety, then you cannot register and participate in the Program. Users also cannot participate where in so doing, they would violate any applicable law or regulations. Pinpoint IT reserves the right to change this program in any way without prior notice to the participants of the Program.
Eligibility
This Program is void where such referral programs are prohibited. The Program is open to any staff member of an existing Pinpoint IT Client or Pinpoint IT Partner as registered with us.
Users who refer others to the program are “Referrers”; those who are referred are “Referred Customers.” Referrers may be eligible to receive “Gift Cards” for every qualified referral. Referrers must be legally able to participate in the Program, and must be one of:
1) An owner or staff member (Users) of an existing Pinpoint IT Client and registered as a ‘Referrer’, or
2) A staff member of an existing Pinpoint IT Partner, or
3) A staff member of Pinpoint IT consulting partners.
When registering for the Program, Referrers must use the same email address that is registered with their company (not personal email accounts). Pinpoint IT reserves the right to determine if a Referrer’s email address domain makes them eligible for the Program and will confirm by way of acceptance in the Program where a registration of a referrer is accepted.
Participation in the Program represents an ongoing relationship with you, for privacy purposes. So long as you remain in the Program, or you have open referrals, you will be considered an active member of the Program and of the Pinpoint IT Referral Community. You hereby authorise Pinpoint IT to contact and communicate with you regarding with the operation of the program. Please see Pinpoint IT’s privacy policy for further details on your privacy rights.
Companies and employees of Pinpoint IT entities or their subsidiaries, affiliates or promotional agencies, including immediate family and household members, are not eligible to participate in the Program.
Qualified Referrals
Referrers will be required to enter their details and the details of the Referred Customer into a form found at http://pinpointit.com.au/referrals or other forms that may be specified by Pinpoint IT for certain referral partners or conditions.
If there is an existing deal in progress or the Referred Customer is already a client of Pinpoint IT then no referral fee will be paid unless stated in writing that a special promotion applies.
Referrals must be a warm referral Ie. the person who is Referred Customer must know that the Referrer is referring them.
Referrers should check these details prior to submitting details of a Referred Customer, including their acceptance to be enrolled into a referral program.
All Pinpoint IT Entities’ decisions are final and binding, except where prohibited, including decisions as to whether a Qualified Referral is valid, when and if to terminate the Program, and whether, if at all, to change the Program. Any changes to the program will published to these Terms and Conditions and a notification sent via email to registered Referrer’s email address and, except where prohibited, will become effective as at the date the email is sent or the published changes are made. If a Referrer has referrals pending qualification at the time that updates are sent, those pending referrals shall be validated and Referral Rewards issued under the terms as valid at the time the Referred Customer signed up for the Service, not when the referral was first registered.
Referrer’s Code of Conduct
Referrer’s agree that they will not violate any of these Terms, or otherwise engage in activity that could be considered harassment toward other users. Users agree not to use the Program to:
- Violate the intellectual property rights of Pinpoint IT
- Spam or otherwise create bulk distributions to potential Referral Customers
- Collect or attempting to collect personal data about users or potential Referred Customers
- Engage in any actions that are designed to disrupt or undermine the Program
- Make attempts to gain unauthorized access to the software or the Program for any reason
- Transmit files that contain bots, viruses, works, Trojan horses, or any other file that could contaminate or otherwise destroy Pinpoint IT intellectual property or stop the function of the Pinpoint IT services
- Engage in illegal or unsportsmanlike activities
- Engage in behaviour designed to annoy or harass others
- Engage in actions that disparage or malign or call into question the reputation of Pinpoint IT, in Pinpoint IT’s sole discretion
Privacy
Participation in the Program may require a Referred Customer and/or a Referrer to submit personal information about themselves. The personal information will be collected, processed and used in accordance with Pinpoint IT’s Privacy Policy which can be found at http://pinpointit.com.au/privacy. In addition, personal information may be used by Company on Company’s behalf, to contact Users with regards to participation in the Program and to receive communications from Pinpoint IT or third party administrators of the Program. It is therefore important that any referred party is aware of their acceptance to be enrolled into this program.
Reservations of Rights
We reserve the right to modify or amend at any time these Terms and the methods through which rewards are earned. We reserve the right to disqualify any User at any time from participation in the Program if he/she does not comply with any of these Terms. Pinpoint IT Entities’ failure to enforce any term of these Terms shall not constitute a waiver of that provision.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE PROGRAM. SHOULD SUCH AN ATTEMPT BE MADE, PROGRAM ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING LEGAL FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION
THE CONTENT, INFORMATION, LINKS AND FUNCTIONALITY OF THIS WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF NON INFRINGEMENT OF THIRD PARTY RIGHTS, TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL COMPONENTS.
